Terms and Conditions

1. Purpose and scope
This is a translation for convenience. The Portuguese version is the legally binding one.
These terms govern the use of the ProClub platform, made available to the subscribing club as a software-as-a-service (SaaS) offering. By creating an account or accepting an invitation, the user accepts these terms.
The client of the service is the sports club that contracts the platform. Each user accesses the platform through the club they belong to, with the role and permissions defined by the club.
2. Accounts and roles
The club is responsible for creating and managing its users' accounts, as well as for the roles assigned (board, administration office, coaching staff, employees, athletes and parents/guardians).
The user is responsible for the confidentiality of their credentials and for all activity carried out on their account.
3. Acceptable use
It is forbidden to use the platform for unlawful purposes, to host or disseminate illegal content, or to process personal data without a legal basis for doing so.
The club undertakes to collect and process the data of underage athletes in compliance with the GDPR and applicable legislation on the protection of minors.
4. Service availability
ProClub applies commercially reasonable efforts to keep the service available. Interruptions for maintenance may occur and will be scheduled whenever possible.
Periods of unavailability caused by third parties (network operators, infrastructure providers) or by force majeure are excluded.
5. Data and ownership
The data entered by the club (athletes, members, documents, communications) is the property of the club. The club may export it at any time.
ProClub processes this data on behalf of the club, under the terms of the Data Processing Agreement published on this website.
6. Payments
Subscription plans are charged to the club under the agreed terms. Payments made by members and parents/guardians (membership fees, shop, donations) are processed through the payment provider and settled directly to the club.
Refunds of payments made by members follow the rules set by the club.
7. Termination and exit
Either party may terminate the relationship under the terms agreed at contracting. After termination, the club has a data export period, after which the data is deleted from active systems.
